This Canadian photograph appears to have been taken circa 1840, and certainly prior to Bourget's death in 1882, and therefore it can reasonably be assumed that the author has been dead for 100 years and the work has entered the public domain. It is unclear whether the first publication of the image was in Canada or the US but in any case it occurred prior to 1923.
